1. Privacy Policy Statement

We, Great Wall Property Agency, are committed to fully complying with the recognized standards for the protection of personal data privacy as required under the Personal Data (Privacy) Ordinance. To this end, we ensure that our staff adhere to the strictest levels of security and confidentiality.

2. Collection and Use of Personal Data
The personal data you provide may include your name, phone number, address, identification number, and personal details contained in various property agency agreements, provisional sale and purchase agreements, and tenancy agreements. The personal data we collect from you may be used for the following purposes:

(i) To carry out estate agency work related to the sale, purchase, lease, or mortgage application (as applicable) of properties for which you have appointed or will appoint us as your agent.

(ii) We intend to use your name and contact details (including phone number, fax number, email address, and/or mailing address) for direct marketing of our property agency services.

(iii) To promote our property agency services and provide you with information about properties available for sale or lease in the market. When we receive your notification to stop using your personal data for promotional purposes, we will immediately cease doing so.

(iv) To transfer relevant information to our partner estate agents, banks, the Hong Kong Mortgage Corporation, or financial institutions for the purpose of handling mortgage or loan applications, to the Hong Kong Housing Authority, the Housing Department, the Hong Kong Housing Society, solicitors and/or debt collection agencies engaged by us for the recovery of overdue commissions or other fees, and to other persons as required by law, regulatory rules, or orders from authorities in the Hong Kong Special Administrative Region or other jurisdictions.

Apart from the above, we will not use your personal data for any other purpose without your explicit consent, unless such use is required or authorized under applicable laws, legal rules, or court orders in Hong Kong.

3. Retention Period
The personal data you provide will be retained in accordance with the Estate Agents Ordinance (Cap. 511) and its subsidiary legislation, the guidelines issued by the Estate Agents Authority from time to time, or any applicable laws and regulations relating to such data or documents containing such data.

According to the Estate Agents Authority’s practice circular on anti-money laundering measures, we will retain estate agency agreements, property viewing forms, or similar agreements for five years from the date of signing the provisional sale and purchase agreement.

Under the Estate Agents Practice (General Duties and Hong Kong Residential Properties) Regulation, we will keep (i) records of all listings of residential properties and copies of all estate agency agreements relating to residential properties for three years from the date of receipt or signing (whichever is applicable), and (ii) copies of all receipts issued to clients for received funds and deposit slips for such funds into trust accounts opened with an authorized institution under the Banking Ordinance (Cap. 155) for three years from the issue date of the receipts.

4. Security
The personal data you provide will only be accessible by staff members who have received appropriate training in handling such information, are bound by confidentiality obligations, and require such access to perform the uses stated in section 2 above.
